They misrepresented the mechanical condition of the car – I purchased a 2000 Mercury Cougar from Baires Auto Market on October 21, 2011. When I got in the car to drive off the lot after signing the paperwork, the check engine light went on before I could even back the car out. I was assured by David that it wasn't anything to be alarmed about, and they proceeded to clear the error code. The car started bucking on the freeway about a week or two later with RPM's as high as 6000 at times. I had to take it back twice telling David I suspected it was a transmission problem. I LITERALLY HAD TO BRING THEM VIDEO EVIDENCE OF THE PROBLEM I WAS EXPERIENCING AND THEN THEY COULDN'T PRETEND IT WASN'T AN ISSUE. Mechanic had been "unable to duplicate" the problem the previous 2 visits. Then they replaced 2 sensors.
When the car began running really sluggish just a couple of weeks later, I took it in to a mechanic who suggested the range sensor was either installed incorrectly, or it was an indication the transmission was going to fail soon. Sure enough, with only a couple thousand miles driven since purchasing from Baires Auto Market, the transmission on my 2000 Mercury Cougar has failed.
The principle of "implied" warranties is that any car you buy can be safely purchased on the assumption that it is roadworthy and will perform for a reasonable amount of time without undue expense or trouble on your part.
I believe the breach of implied warranty occurred at the time I purchased the vehicle from Baires, and feel the minimal repairs which were authorized on the vehicle demonstrate the continued breach of implied warranty as the repairs did not remedy the issues for "a reasonable amount of time" as I have driven just a few thousand miles since purchasing this vehicle in October.
Another concern I have is that I was never given a bill of sale. I don't know if it has anything to do with the fact that I was only given handwritten receipts for all 3 payments made for the purchase price of the vehicle, totaling a little less than $5000--but I was given a computer generated invoice when billed for %50 of work done under warranty...???
IF YOU ARE EVEN CONSIDERING BUYING A CAR, DON'T BUY "AS IS" BECAUSE YOU DON'T GET ANY WARRANTY, EXPRESSED OR IMPLIED.
I got a 30 day warranty which was essentially worthless because of shoddy repairs which didn't even fix the issue at hand. I have filed a complaint with the BBB.
